After staying in the shadows, the person who has filed a complaint against a Territorial Court Judge has come to light.
Her name is Martha Chertkow – a former crown attorney.
Chertkow filed a complaint with the Judicial Council alleging Judge Donovan Molloy is guilty of misconduct. Aside from Chertkow’s complaint, it’s reported that there have been several others filed against Molloy including berating lawyers – some breaking down in tears. He once threw out dozens of charges in Hay River because a crown prosecutor missed her flight. He’s also been a vocal critic of the justice system in the NWT.
Chertkow made her first appearance before the Judicial Council Wednesday via video held at the Quality Inn hotel in Yellowknife where the panel addressed preliminary motions.
Molloy did not attend the meeting and was represented by his lawyer who asked for an adjournment citing details about Molloy’s ongoing health problems should remain private. Last April, Molloy announced that he was stepping down from the bench.
After a brief meeting, the council agreed to keep Molloy’s health matters private but ruled the hearing should proceed at a later date.
The matter is set to resume next January with more preliminary motions followed by the actual hearing in February.
Once the hearing in Yellowknife wraps up, the Judicial Council may warn, reprimand, or suspend Molloy, or recommend to the minister of justice that he be removed from office.
