Behchoko teen sexually assaulted by man out on bail for another sex assault

A Behchoko man is to be sentenced on Friday after he pleaded guilty to sexually assaulting a girl in her early teens while he was out on bail for a previous sexual assault.

Peter John Lafferty, 42, appeared in Supreme Court in Yellowknife Monday for a sentencing hearing on both sexual assaults.

Court heard that back on October 1st of 2016, Lafferty was drinking with an adult woman at his residence when someone called RCMP, concerned about her safety.

Mounties had to break down the front door when no one answered and found Lafferty and the unconscious victim inside.

There was DNA evidence that a sexual assault had occurred, court heard.

The victim was transferred for medical treatment by paramedics.

Lafferty was arrested, charged and eventually released on bail.

Court heard that the woman has since left the community and declined to provide a victim impact statement.

Court heard that later that same month, Lafferty sexually assaulted a girl while she was laying down in a bedroom after drinking alcohol inside Lafferty’s residence.

Other people in the home at the time entered the bedroom, found Lafferty on top of the crying teenager, and pushed him off before one of them punched him in the face.

RCMP were called and they found an intoxicated Lafferty passed out and bleeding inside his home.

Again DNA evidence showed Lafferty had sexually assaulted the victim.

He has been in custody since he was arrested and charged with that offence on October 22, 2016.

The Crown prosecutor described the attacks as major sexual assaults where Lafferty took advantage of two intoxicated victims while he himself was intoxicated.

She pointed out that Lafferty has one previous sexual assault conviction in 1999 for which he received a two-year jail sentence.

In a hushed voice, Lafferty apologized to both victims, neither of whom were in the courtroom at the time.

A joint sentencing submission from the Crown and Lafferty’s lawyer calls for a total sentence of four years and nine months for both sexual assaults.

If the judge agrees to that joint submission, taking into account his time spent in pre-trial custody, Lafferty would have just over two years left to serve.
